AI and Your Professional Liability Policy: A Smart Tool, Not a Sure Thing

Imagine being handed a condensed overview of your professional liability policy that summarizes dense legal language and deciphers complex endorsements and exclusions within seconds. That’s just one of the many capabilities of artificial intelligence (AI), and for engineering firms, consultants, and other professionals, it sounds almost too good to be true. However, like most subjects in insurance, the full picture is a little more complicated.

AI Advantages

The biggest advantage AI brings to policy review is speed. Traditional reviews can take hours of carefully combing through technical language, comparing endorsements, and flagging potential coverage gaps. AI-powered platforms can do much of that work in minutes, if not seconds, highlighting key provisions such as limits of liability, retroactive dates, and defense obligations.

For smaller firms unable to afford extensive legal or insurance consultations, AI can serve as an affordable first step in the process, going so far as to help compare and contrast multiple insurance policies side by side. AI can even chart a comparison between the policies to easily determine which policy and coverage best meet the needs of a firm.

AI can also help catch things humans might miss. Insurance policies are filled with technical wording that can easily be misinterpreted or overlooked. A well-trained AI tool can flag broad cyber exclusions, restrictive contractual liability language, or exclusions tied to emerging risks, like artificial intelligence itself. Catching these issues before a claim ever occurs is exactly the kind of insight that can save a business from a costly surprise down the road.

AI Precautions

However, while AI can summarize your policy in simpler terms, it can’t tell you how a court will interpret it. Insurance policies are legal contracts. Subtle wording can have a dramatic impact on whether or not a claim will be covered. AI could also miss state-specific legal language or fail to recognize the significance of an endorsement; missing these details could leave a firm exposed to an uninsured loss when it matters most.

There is also the risk of putting too much confidence in AI. AI-generated summaries can look polished and authoritative, so much so that business owners may assume the analysis is complete and legally accurate. In reality, professional liability claims are often highly technical and fact-specific. Human expertise from an experienced insurance broker or attorney remains critical.

AI as a Tool

Think of AI as a useful first step, not a final answer. Use it to get a faster, clearer picture of your coverage. Next, follow up with a trusted insurance professional to more thoroughly review. When used this way, AI can help you ask more informed questions, catch potential coverage gaps earlier, and make more informed decisions. When used carelessly and without verifying for accuracy, AI can create a false sense of security that only becomes apparent after a costly claim.

With so many AI platforms to pick from, be sure to do your due diligence and pick a platform that specializes in complex legal language, risk analysis, and identifying nuances in insurance coverage, limits, and exclusions. And, as with all information uploaded to the internet, be careful about providing AI with personal information that could be used by bad actors.
